SimpliSafe Excess Payback Program – Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY GOVERN YOUR PARTICIPATION IN THE SIMPLISAFE EXCESS PAYBACK PROGRAM. THIS PROGRAM IS NOT INSURANCE.
1. Introduction and Program Overview
The SimpliSafe Excess Payback Program (the "Program") is a discretionary benefit offered by SimpliSafe, Ltd. ("SimpliSafe," "we," "us," or "our") to eligible SimpliSafe professional monitoring subscribers. Subject to these Terms and Conditions, the Program offers a potential reimbursement of up to Three Hundred Fifty Pounds (£350) towards a Subscriber's buildings and/or contents insurance compulsory excess incurred as a direct result of a covered burglary.
THIS PROGRAM IS NOT AN INSURANCE POLICY, NOR IS IT A SUBSTITUTE FOR BUILDINGS AND/OR CONTENTS INSURANCE. SIMPLISAFE IS NOT AN INSURER AND DOES NOT SELL, UNDERWRITE, OR ACT AS AN AGENT FOR ANY INSURANCE PRODUCTS. YOU REMAIN SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ADEQUATE INSURANCE COVERAGE FOR YOUR PROPERTY.
2. Definitions
Subscriber: An individual who has purchased a SimpliSafe system and maintains an active, continually paid professional monitoring subscription.
SimpliSafe System: The SimpliSafe security hardware purchased and installed by the Subscriber.
Professional Monitoring: The paid service provided by SimpliSafe where SimpliSafe’s designated monitoring centres receive alarm signals from the SimpliSafe System and respond according to established protocols under a Pro Premium plan.
Covered Burglary: An unauthorized entry into the Subscriber's Monitored Premises, subject to the exclusions set forth in Section 8, evidenced by verified break-in and an accepted claim under the Subscriber's valid buildings and/or contents insurance policy, resulting in property loss. Insurance coverage, claim made and compulsory excess paid must be confirmed on Insurer letterhead.
Monitored Premises: The interior of the building or home property where the SimpliSafe System is installed and activated. This explicitly excludes all outside areas, including but not limited to, gardens, detached garages, sheds, vehicles, and external structures.
Property Loss: Tangible personal property stolen or damaged during a Covered Burglary within the Monitored Premises.
Insurance Compulsory Excess: The amount of an insured loss that a Subscriber is responsible for paying before their insurance provider pays a claim.
3. Program Term and Renewal
This Program is offered as an annual benefit that automatically renews each year for eligible Subscribers, provided their qualifying Pro Premium Professional Monitoring subscription remains active and continually paid. The Program will remain in effect for such Subscribers unless modified, suspended, or terminated by SimpliSafe in accordance with Section 12 below.
4. Eligibility Requirements
To be eligible for reimbursement under the SimpliSafe Excess Payback Program, ALL of the following requirements must be met to SimpliSafe’s reasonable satisfaction:
a. Active Professional Monitoring (Pro PremiumPlan Only): The Subscriber must have purchased and maintained an active, fully paid (e.g., no past due invoices) Professional Monitoring subscription from the time of the Professional Monitoring subscription activation through the date of the Covered Burglary and up to the time the reimbursement request is submitted.
b. Subscriber Eligibility: The Subscriber must be the monitoring plan primary owner and at least eighteen (18) years old at the time of the Covered Burglary
c. Properly Installed SimpliSafe System: The SimpliSafe System must have been properly installed according to SimpliSafe's instructions.
d. System Armed at Time of Loss: The SimpliSafe System must have been fully armed (e.g., in "Home" or "Away" mode, not "Off" or "Practice") at the time the Covered Burglary occurred. Evidence from SimpliSafe’s system logs will be used to verify this.
e. Camera with Video Verification: The Subscriber must have at least one SimpliSafe Camera installed and actively enrolled in SimpliSafe video verification at the time of the Covered Burglary.
f. Valid Insurance Policy: The Subscriber must hold a valid buildings and/or contents insurance policy that covers the reported Property Loss.
g. Property Loss from Covered Burglary: The reimbursement request must be for Property Loss directly resulting from a Covered Burglary.
h. Timely Reimbursement Request: The Subscriber must submit a complete reimbursement request to SimpliSafe within sixty (60) calendar days of the date of the Covered Burglary.
5. Reimbursement Amount and Limitation
If a Subscriber meets all eligibility requirements, SimpliSafe may, at its sole discretion, reimburse the Subscriber for up to Three Hundred Fifty Pounds (£350) of their buildings and/or contents insurance compulsory excess, if any, associated with the Covered Burglary and Property Loss. The reimbursement amount will not exceed the actual compulsory excess incurred by the Subscriber.
Limitation: A Subscriber is eligible for only one (1) reimbursement under this Program per calendar year (January 1st to December 31st) per active SimpliSafe professional monitoring subscription, regardless of the number of Covered Burglaries or losses incurred within that calendar year.
6. Claim Submission Process
To request reimbursement, the Subscriber must follow all the required instructions set forth at here and submit a complete reimbursement package as directed by SimpliSafe. All information provided will be subject to our Privacy Policy found on https://simplisafe.co.uk/legal/privacy-policy.
The complete reimbursement package must include ALL of the following documentation:
a. Excess Payback Certificate: A copy of the Excess Payback certificate signed by the Subscriber.
b. Accepted Insurance Claim Documentation: A copy of the accepted claim documentation from the Subscriber’s buildings and/or contents insurance provider, which clearly shows:
* The date of loss.
* The total amount of the covered loss.
* The applied insurance compulsory excess amount.
* Proof of the Subscriber's payment of the compulsory excess.
c. Contact Information: Current mailing address, email address, and phone number for the Subscriber.
Incomplete or improperly submitted requests will not be processed and may be returned to the Subscriber.
7. Review and Approval Process
SimpliSafe reserves the right to thoroughly review and verify all information and documentation submitted with any reimbursement request. This may include, but is not limited to, cross-referencing information with SimpliSafe’s system logs (e.g., alarm history, arm/disarm status), contacting the Subscriber's insurance provider, and/or contacting law enforcement agencies.
SimpliSafe reserves the right to reject any application for reimbursement that:
Does not comply with all of the eligibility requirements set forth in Section 4.
Contains incomplete, illegible, false, or misleading information.
Does not contain accurate and complete contact information, such as a valid email address for payment.
Is submitted outside of the sixty (60) calendar day timeframe.
Is deemed fraudulent or suspicious in SimpliSafe's sole discretion.
SimpliSafe's decision regarding reimbursement is final and binding.
8. Exclusions and Limitations
The SimpliSafe Excess Payback Program does NOT reimburse:
a. Losses not resulting from a Covered Burglary (e.g., fire, flood, natural disasters, vandalism without unauthorized entry, accidental damage).
b. Losses where the SimpliSafe System was not properly installed or was not armed at the time of the Covered Burglary.
c. Losses where the insurance claim was denied or not accepted by the Subscriber's insurance provider.
d. Compulsory excesses for insurance policies other than buildings and/or contents insurance (e.g., auto insurance, health insurance).
e. Losses for which the Subscriber did not incur an insurance compulsory excess.
f. Any amount exceeding the Three Hundred Fifty Pounds (£350) maximum reimbursement.
g. Any amount exceeding the actual insurance compulsory excess paid by the Subscriber.
h. Consequential, incidental, indirect, punitive, or special damages of any kind.
i. Property loss occurring outside the Monitored Premises (e.g., vehicle break-ins).
j. Reimbursement requests received after the sixty (60) calendar day submission window.
k. Losses incurred while the professional monitoring subscription was inactive or had lapsed, or was not a qualifying Pro Premium plan.
l. Losses attributable to the Subscriber's negligence or willful misconduct.
m. More than one (1) reimbursement per Subscriber per calendar year per active SimpliSafe Pro Premium professional monitoring plan.
9. Important Disclaimers
a. Not Insurance: As stated above, this Program is a limited, discretionary reimbursement offering and is explicitly NOT an insurance policy. SimpliSafe assumes no risk of loss, damage, or destruction of property, and does not act as an insurer. As such, SimpliSafe is not regulated by the Financial Conduct Authority (FCA).
b. No Liability for Property Loss: SimpliSafe is not responsible for any Property Loss sustained by the Subscriber, regardless of whether a reimbursement is made under this Program.
c. Program Discretion: SimpliSafe reserves the right to interpret and apply these Terms and Conditions in its sole discretion.
d. No Waiver: SimpliSafe's failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision.
10. Fraudulent Claims
Any attempt to submit a fraudulent, false, or misleading claim will result in immediate disqualification from the Program and may result in the termination of your SimpliSafe services. SimpliSafe reserves the right to determine the validity of any request for reimbursement based on its good faith and reasonable review of your submission.
11. Governmental Reporting
SimpliSafe may be required by law to report certain payments to a governmental authority. In such cases, the Subscriber agrees to provide SimpliSafe with any other necessary financial documentation to comply with applicable reporting obligations. SimpliSafe will not provide tax advice, and Subscribers are encouraged to consult with a qualified tax professional regarding the tax implications of any reimbursements received.
12. Amendment and Termination
SimpliSafe reserves the right to modify, suspend, or terminate the SimpliSafe Excess Payback Program and/or these Terms and Conditions at any time, for any reason, without prior notice. Any such changes will be effective immediately upon posting the revised Terms and Conditions on the SimpliSafe website or other reasonable notice. Such changes will not affect claims properly submitted and validated prior to the effective date of the change.
13. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. For clarity, subscriber agrees that any dispute arising under or relating to this Program shall be governed exclusively according to the dispute resolution procedures set forth in the SimpliSafe’s Terms of Service and Terms of Sale.
14. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Subscriber and SimpliSafe regarding the SimpliSafe Excess Payback Program and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
16. Waiver of Additional Claims
By choosing to voluntarily participate in our reimbursement program, you agree that your acceptance of any reimbursement constitutes a full and final waiver of any and all claims, demands, actions, or causes of action you may have against SimpliSafe related to the underlying burglary or any other events related to this compulsory excess reimbursement request. This ensures a clear and mutual understanding that the reimbursement resolves any outstanding matters or claims you can raise.
By participating in the SimpliSafe Excess Payback Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
